HSE inspectors carried out 188 visits to our UK workplaces during 2006, 18% more than in 2005.

As a result three UK Enforcement Notices were received, compared with two in 2005. These included two Prohibition Notices, for inadequate arrangements for work at height and manual handling, and one Improvement Notice for site plant/pedestrian segregation.

We continue to build strong relations with the HSE. As part of the HSE National Intervention Strategy with major contractors, Balfour Beatty Construction developed a joint Intervention Plan, in 2005 that focused on areas such as occupational health and work at height. The Intervention Plan is reviewed periodically by Balfour Beatty Construction and the HSE. This arrangement has not been extended to other UK companies to date.

The Health and Safety Executive served two Notices of Prosecution on UK operations in January 2006:

  • Balfour Beatty Rail Infrastructure Services received notice of prosecution in relation to a fatal accident during track maintenance works in August 2003. In February 2007 BBRIS were fined £187,000 plus £73,602 costs.
  • Romec (a Balfour Beatty-Royal Mail joint venture company) received notice of prosecution in relation to a fatal fall in July 2003. In June, Romec were fined £100,000 with £22,000 costs.

*On 7th October 2005, Balfour Beatty Rail was fined £10 million plus £300,000 costs in relation to the Hatfield train derailment on 17th October 2000. In June 2006, the Court of Appeal, in handing down its judgement on appeal, reduced the fine by £2.5 million to £7.5 million.

Three citations and fines totalling $160 were received by US operating companies from the Mine Safety and Health Administration (MSHA) during 2006.

Additionally, two formal notices, citing a total of nine violations and penalties of $12,500, were received.

In Italy a fine totalling €2,000 was received for lack of CE certification on equipment.

Three citations were received in Hong Kong with fines totalling HK$38,000, for work at height and lifting equipment violations.

In Dubai, a fine totalling AER 3,000 was received in relation to a Dubai Municipality violation as a result of an accident that resulted in injury during October 2006.
